DIR 615, the hardware version says B2

From tools/firmware on the router config page:
Current Firmware Version : 2.25
Current Firmware Date : 2008/05/16
When I:
Check Online Now for Latest Firmware Version

Nothing appears, i cant believe that there isn't anything more current than  almost 5 years ago as far as firmware.
I came to see this after trying to pin down some speed issues( hardwired through the 615).  DL im getting close to 30Mbs, but UP IF i get .4 im lucky( promised up to 6Mbs by cox).

Are you wired or wireless connected to the router?
Has a Factory Reset been performed?

What ISP Service do you have? Cable or DSL?
What ISP Modem make and model do you have?
Check ISP MTU requirements, Cable is usually 1500, DSL is around 1492 down to 1472. Call the ISP and ask.

Some things to try: - Log into the routers web page at 192.168.0.1. Use IE, Opera or FF to manage the router.
Turn off ALL QoS or Disable Traffic Shaping (DIR only) GameFuel (DGL only and if ON.) options. Advanced/QoS or Gamefuel.
Turn off Advanced DNS Services if you have this option under Setup/Internet/Manual.
Turn on DNS Relay under Setup/Networking.
Setup DHCP reserved IP addresses for all devices ON the router. Setup/Networking. This ensures each devices gets its own IP address when turned on and connected, eliminates IP address conflicts and helps in troubleshooting.
Ensure devices are set to auto obtain an IP address.
If IPv6 is an option on the router, select Local Connection Only or Disable IPv6 options under Setup/IPv6.
Set Firewall settings to Endpoint Independent for TCP and UDP under Advanced/Firewall.
Enable uPnP and Multi-cast Streaming under Advanced/Networking. Disable uPnP for testing Port Forwarding rules.
WAN Port Speed set to Auto or specific speed? Some newer ISP modems support 1000Mb so manually setting to Gb speeds can be supported by the router. Advanced/Advanced Networking/WAN Port Speed
Set current Time Zone, Date and Time. Use an NTP server feature. Tools/Time.

Try single mode G or N or mixed G and N?
Channel Width set for Auto 20/40Mhz or try 20Mhz only.
Try setting a manual channel to a open or unused channel. 1, 6 or 11. 11 for single mode N if the channel is clear.
What security mode are you using? Preferred security is WPA-Personal. WPA2/AES Only. Some WiFi adapters don't support AES, so you might want to try TPIK only or Auto.
What wireless devices do you have connected?
Any cordless house phones?
Any other WiFi routers in the area? Link> Use InSSIDer to find out. How many?
Turn off WISH, and WPS under Advanced.
Try turning off Short GI, WLAN Partition,and Extra Wireless Protection if you have it. Under Advanced/Advanced Wireless.
Enable WMM Enable Under Advanced/Advanced Wireless.

Turn off all anti virus and firewall programs on PC while testing. 3rd party firewalls are not generally needed when using routers as they are effective on blocking malicious inbound traffic.
Turn off all devices accept for one wired PC while testing.

Check cable between Modem and Router, swap out to be sure. Link> Cat6 is recommended.

its a brand new Cisco DCP3010 Docsis3 from the COX store

Called them, they claim MTU is not anything they limit, its a router "thing".

Done, there were 4:, my PC , My DTV HDVR and two others that wernt identified, what are those? I don't have any other devices...oh wait..could this be my smartphones?

it was/is set to auto 10/100Mbs

Reset to computers time, it was set to 2009.

unchecked short GI, WLAN partition was off WMM enable is checked.

Enable WMM Enable Under Advanced/Advanced Wireless.

No third party firewall installed. running Microsoft Security eEsentials as AV, nothing else

I changed all cables to CAT 6 when i changed out the modems to the new one.
After rebooting the router and checked firmware it still says  
Current Firmware Version : 2.25

Current Firmware Date : 2008/05/16 (2.25)
when i press the check now button, it greys out for a second or two then reappears with no "update"

Since there are follow on Revs to your model 615, I don't think there is going to be any other FW versions that are going to be made available for rev B. Current most resent rev for the 615 is Rev I.

Let us know if any of the changes made helps.

How are you speed testing? Wired or wireless? Wired is only recommended for speed testing as wireless can introduce many variables that impact accurate results.

ok, i am testing wired using a speed test called JDs auto speed tester that runs a test every 10 minutes and plots it:

I am concerned about the UL speed as i have alot of data backed up to the cloud and right now im getting .400 average, and COX Cable says i should get between 4 and 6 Mbs.
Any other speed tests i can try to plot over time?

Also disable MS Essentials while testing to be sure there isn't any interferences while testing.

What frequency does that cordless phone run on?

Try speed testing a different PC to compare as well.
